Welcome to One and Wonder. These Terms of Service (the "Terms") govern your use of our website, your purchase of our personalized storybooks, and any related services we provide (collectively, the "Service"). By accessing our website, placing an order, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
These Terms are governed by Moroccan law, including:
One and Wonder is a personalized children's storybook brand based in Morocco (the "Brand," "we," "us," or "our"). We design, write, illustrate, and print every book in Morocco.
For the purposes of these Terms:
You must be at least 18 years old to place an order on our website.
By placing an order, you confirm that you are an adult and that you are either the parent or legal guardian of the Child, or another adult family member acting with the parent's or guardian's express consent.
Children and minors are not permitted to create accounts, upload photographs, or place orders through our website.
You are responsible for keeping your account credentials (if you create an account) confidential and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.
In compliance with Article 29 of Law 31-08, we make the following information clearly available before you place your order:

In compliance with Article 65-5 of the DOC (added by Law 53-05), you have the opportunity to verify the details of your order — including total price — and to correct any errors before final confirmation.
The contract between you and us is formed when:
The order confirmation constitutes binding acceptance of your order. Pursuant to Article 417-1 of the DOC (added by Law 53-05), an electronic writing has the same probative value as a paper writing.
We reserve the right to refuse or cancel any order in our reasonable discretion, including (but not limited to) cases where:
If we cancel an order before production begins, we will refund any amount you have paid using the same payment method.
Our checkout supports multiple currencies for international visitors. Final billing is conducted in MAD. Currency conversion rates are applied by your payment provider.
To produce your Storybook, you provide:

By uploading a photograph, you grant us a limited, non-exclusive, non-transferable, revocable license to use the photograph solely for the purpose of designing, producing, and delivering the Storybook you ordered. This license is strictly limited:
You may not upload, submit, or attempt to use the Service to produce:
Any attempt to misuse the Service in this manner will result in immediate cancellation of the order, refusal of refund (where production has begun), suspension of access to the Service, and reporting to the appropriate authorities where required by law.
These timelines are estimates. The Brand's general obligation to perform the contract in accordance with its terms is governed by Law 31-08 and the DOC.
We currently deliver throughout Morocco. International shipping is not yet available.
Shipping costs are calculated at checkout based on the delivery address and are paid by the Customer.
In accordance with general principles of Moroccan sales law, risk of loss passes to the Customer upon delivery of the Storybook to the Customer or to a person designated by the Customer at the shipping address provided.
The Customer is responsible for providing an accurate and complete shipping address. The Brand is not responsible for non-delivery, delayed delivery, or additional costs caused by an incorrect or incomplete address provided by the Customer.
Where the brand fails to deliver within the agreed time, the Customer's rights are governed by Article 13 of Law 31-08 (where applicable to the order value) and the general provisions of the DOC, including the right to formally notify the brand (mise en demeure) and, if appropriate, to terminate the contract and obtain a refund of sums paid.
Article 36 of Law 31-08 grants Moroccan consumers a 7-day right of withdrawal for distance contracts. This right is of public order (d'ordre public), meaning it cannot be waived by contract in cases where it applies.
Article 38 of Law 31-08 lists the exceptions to the right of withdrawal. It expressly excludes:
"…la fourniture de biens confectionnés selon les spécifications du consommateur ou nettement personnalisés…"
("…the supply of goods made according to the consumer's specifications or clearly personalized…")
Each Storybook we produce is personalized specifically for the Child named in the Order, using the Child's photograph, name, age, gender, and eye color. Each Storybook is unique, made-to-order, and cannot be resold.
For this reason, once production begins, orders cannot be canceled or returned for reasons of withdrawal, except in the cases described in Sections 10 and 11 below (cancellation window and legal guarantees).
This exclusion does not affect the Customer's rights under the legal guarantee of conformity described in Section 11.
You may modify or cancel your order within 24 hours of order confirmation, free of charge, by contacting us at contact@oneandwonder.ma. Modifications during this window may include:
After the 24-hour window has elapsed, production has begun on your custom Storybook. At that point:
We strongly encourage Customers to carefully review their order details before confirming.
Where the Storybook arrives physically damaged in transit (torn pages, bent cover, water damage, packaging visibly compromised), the Customer is encouraged to notify us within 48 hours of delivery at contact@oneandwonder.ma, with photographs clearly showing the damage. Prompt notification helps us process shipping-related claims with our delivery partners. The Customer's legal rights under Section 11.1 remain available regardless.
If your Storybook contains an error caused by us — wrong name, wrong language, missing pages, printing defects, or any other non-conformity attributable to our production — you may exercise your rights under the legal guarantee at any time within the period set out in Section 11.1.
The legal guarantee does not cover:
All content on our website and within our Storybooks — including stories, illustrations, designs, brand name, logo, fonts, photographs (other than those uploaded by Customers), software, and any related materials — is the exclusive property of One and Wonder or its licensors and is protected by Moroccan and international intellectual property law, including Law No. 2-00 on copyright and related rights, as amended by Law No. 34-05.
When you receive your Storybook, you own the physical book and may use it for personal, non-commercial purposes — reading it with your child, displaying it in your home, gifting it, and so on.
You do not acquire any intellectual property rights in the underlying story, illustrations, or design, all of which remain the exclusive property of One and Wonder. You may not:
You retain all rights to the photograph you upload. We use it only under the limited license described in Section 7.2.

We reserve the right to suspend or terminate access to our Service for any user who violates these provisions.
The processing of personal data — including the Child's photograph, name, age, gender, and eye color, and the Customer's contact and payment information — is governed by our Privacy Policy and conducted in accordance with Law No. 09-08 on the protection of individuals with regard to the processing of personal data.
If you have opted in, we may send you newsletters, special offers, and brand updates by email and WhatsApp. You may unsubscribe from these communications at any time by clicking the unsubscribe link in any email or by replying "STOP" to any WhatsApp message. Unsubscribing from marketing does not affect transactional communications about your order.
To the fullest extent permitted by Moroccan law, and subject to the mandatory consumer protection rules that cannot be waived by contract:
Any clause of these Terms that would, under Articles 18 to 20 of Law 31-08, be considered abusive, shall be deemed unwritten without affecting the validity of the remaining provisions.
We shall not be liable for any failure or delay in performance under these Terms caused by events beyond its reasonable control, including but not limited to natural disasters, fires, floods, strikes, courier failures, government actions, war, civil unrest, pandemics, or failures of telecommunications or internet infrastructure.
We may modify the Service or these Terms at any time. When we make material changes to these Terms, we will:
Your continued use of the Service after the effective date of the modified Terms constitutes acceptance of the modifications. If you do not agree to the modifications, you must stop using the Service.
Modifications do not apply retroactively to orders already confirmed before the effective date.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law.
Upon termination:
These Terms are governed by and interpreted in accordance with the laws of the Kingdom of Morocco, without regard to conflict-of-law principles.
If you have a dispute or complaint, please first contact us at contact@oneandwonder.ma. We will try in good faith to resolve any dispute informally within 30 days of receiving your complaint.
These Terms do not deprive you of any rights granted by Moroccan consumer protection law that cannot be waived by contract.
Entire agreement. These Terms, together with our Privacy Policy and any other policies referenced, constitute the entire agreement between you and us regarding the Service.
Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
No waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, or sale of assets.
Language. These Terms are originally written in English. In compliance with Article 206 of Law 31-08, an Arabic translation will be made available. In case of discrepancy between language versions, the Arabic version shall prevail for Moroccan customers.
Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
